The rapid evolution of AI has introduced new forms of risks for creators. Copyrighted works—including writing, images, videos, sound, voice, and likeness—are being used in AI training without consent. Online users can reproduce, generate from, and publish this content without authorization, challenging the boundaries of creative ownership.
While copyright law expressly protects creative works, proposals in the UK and EU for broad data mining exceptions that allow AI-scraping of copyrighted material have raised significant concerns. These exceptions shift the burden onto creators, who are asked to opt out despite the absence of standardized methods.
We believe this framework is flawed. Copyright law should prevail. However, the growing number of lawsuits and policy debates are questioning these principles, urging us to anticipate and address these challenges.
